1. Agreement to Terms
By accessing or using the Zyro website, scripts, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you disagree with any part of the terms, then you may not access the Service.
2. Pre-launch & Beta Service
IMPORTANT: You acknowledge that the Service is currently in a pre-launch, "Beta" phase. You understand and agree that the Service may contain bugs, be materially different from the final version, and be modified or discontinued at any time. Your use of the Beta Service is at your own risk.
3. The Service
Zyro provides users with a suite of search engine optimization tools, delivered via a dashboard and a single JavaScript snippet installed on the user's website (the "Script"). The features of the Service include, but are not limited to: automated technical analysis and optimization (such as schema markup generation); personalized keyword and content strategy recommendations based on user website data and connected third-party services; AI-powered tools for generating draft content; and user behavior analytics, such as visual heatmaps. We reserve the right to withdraw or amend our Service at our sole discretion without notice.
4. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding your password and for all activities that occur under your account.
5. Subscriptions and Billing
The Service will be billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring basis ("Billing Cycle"). Your Subscription will automatically renew at the end of each Billing Cycle unless you cancel it through your account management page.
6. Intellectual Property
The Service and its original content (excluding your website's data and content you generate), features, and functionality are and will remain the exclusive property of Zyro and its licensors.
6.1. User-Generated and AI-Generated Content
Our Service includes tools that allow you to generate written content ("AI-Generated Content"). Upon creation, you own the copyright to the specific articles and text you generate using the Service. However, you are solely responsible for reviewing and ensuring that any AI-Generated Content is accurate, does not infringe on any third-party rights, and is appropriate for your use. Zyro makes no warranties about the uniqueness or factual accuracy of AI-Generated Content. You agree to use the AI-Generated Content at your own risk.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Zyro, its affiliates, directors, or employees, be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of **Victoria, Australia**, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts located in Melbourne, Victoria.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.
